Is there Free Speech in School?

A local high school student was arrested and charged with a misdemeanor for an essay he turned in as homework. The Chicago Tribune quotes ACLU of Illinois spokesman Ed Yohnka:

"One of the elements is that some sort of disorder or disruption is created," said Ed Yohnka, a spokesman for the American Civil Liberties Union of Illinois. "When something is done in private -- when a paper is handed in to a teacher -- there isn't a disruption."

Yohnka also said that it was inevitable that schools would focus on potentially threatening writings in the aftermath of what happened at Virginia Tech, where a gunman killed 32 students and teachers, then fatally shot himself.

"After so much attention was paid last week to what was written by the shooter at Virginia Tech, I think there is no question people will be paying more attention to things like this," he said.

This is a clear First Amendment issue. It's these kinds of rash decisions that disrupt the lives of law-abiding citizens and undermine our fundamental rights.

There was nothing in Allen Lee's speech that was any worse than what we see at the movies or in Stephen King books.


The articles in the Chicago Trib about this student raise some disturbing questions. It was stated that Allen Lee is an "A" student and an athlete. Since he goes to a small suburban school where students are usually well known by the faculty, was this a faculty plot against a student of Oriental background? Have school authorities been working with the student and his family in the past? What does the School Psychologist have to say about the student's psychological history? Was his arrest the last resort or the first response?


Allan Lee's hopes of a carear in the Marine Corps has effectively been brought to an abrupt end by this over-reaction. What is the ACLU going to do to protect his free speech? For the sake of precedent if nothing else, appeal this court case and clear Allan Lee's name.


This was a completely devastating blow to the rights of Americans. Freedom has taken the back seat to the imagination and groundless claims of a frail school staff blinded by paranoia and fear.

I have written several letters to members of congress including presidential canditates in hopes this issue is made more aware of.
